Two important Points

• Refund cover is free and included on all bookings until 8am on the day the booking starts. Cancellations after that time are not possible. Equipment returned before the end of the rental period will not be eligible for a refund. It is not possible to to cancel and refund a booking that has already started.

• Should a cancellation be made on or after the first day of the booking period, a cancellation fee of 100% of the equipment which has been booked or of the service which has been booked will be retained.

Scope of Application

The following general terms and conditions apply between Trophy Suisse SA Ski Service (hereinafter referred to as Ski Service) and the customer (hereinafter referred to as “the customer”). They are restricted solely to reservation/booking/payment for rental equipment via the internet.

Online booking/paying/reservations

Customers who book and pay for or reserve their rental equipment online receive immediate confirmation via e-mail. Equipment will require fitting and adjusting for safety reasons when the customer collects the equipment.

Prices

The prices published by Ski Service shall be binding. For booking/paying online, the rental price must be paid online by credit card/postcard. The prices include all statutory taxes and charges.

Insurance

The customer must pay for all insurance such as third-party liability, breakage, material defect, theft, etc. Ski Service will levy an extra charge of 10% of the total rental price to cover breakage and theft on certain types of equipment. This insurance is optional at the choice of the customer. It excludes damage or loss resulting from gross negligence.

Cancellation

Claims

Claims of any kind relating to a booking must be addressed to Ski Service in writing (by e-mail) immediately upon receipt of the booking confirmation. In the event of later claims, the customer shall bear the full loss resulting therefrom.

Extended benefits

Extended benefits such as changing to a higher category, additional rental equipment, etc., can only be arranged locally with Ski Service. In the event of a change to a lower category, there will be no refund/reduction of the price.

Collection and return of the rental equipment

The customer shall collect the rental equipment on the first day of rental from the rental agent specified on the booking confirmation. Upon request, the rental equipment may be collected after 15:00 on the day before the first day of rental. The rental equipment must be returned before close of business on the last day of the agreed rental period. In the event of longer usage of the rental equipment, the difference between the rental term paid for and the period for which the equipment was actually used shall be charged, under the normal rental terms that apply.

Deposit guarantee

A credit card scan and photo ID scan may be required as a deposit guarantee.

Data protection

The customer agrees to the collection and use of personal data for the processing of the rental transaction and the further information of the customer. Ski Service warrants simultaneously that it will use the data it collects only for the above purposes. For further information, please view our privacy policy.

Liability

Any liability claims relating to the rental equipment arising on the grounds of theft, breakage, claims from ski or snowboard accidents, etc., shall be asserted solely against Ski Service.

Applicable law and court of jurisdiction

Swiss law shall apply for these general booking terms. Sole court of jurisdiction is Entremont, Valais. Ski Service reserves the right to prosecute the customer at the location of its registered office or place of residence or before any other appropriate court or competent authorities.

Newsletter

You will be automatically added to the Ski Service mailing list. Ski Service sends no more than 5 newsletters a year with special offers, ski hire discount codes, and package holiday offers. You may unsubscribe at any time by clicking ‘Unsubscribe’ at the bottom of the newsletter.

3rd party suppliers

The third-party suppliers and private tour guides providing products or other services on this website are independent contractors and not agents or employees of Ski Service. Ski Service is not liable for the acts, errors, omissions, representations, warranties, breaches, negligence, or misconduct of any such suppliers or private tour guides or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom or otherwise arising from your booking of a product or service or your use of a product or service. Ski Service has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure, or other causes beyond their direct control, and they have no responsibility for any additional expense, omissions, delays, re-routing, or acts of any government or authority.

In no event shall Ski Service (or their officers, directors, and affiliates) be liable for any direct, indirect, punitive, incidental, special, exemplary, or consequential damages (including without limitation loss of data or information or costs to procure substitute goods or services) arising out of, or in any way connected with, product or service bookings made by you through this website or your access to, display of, or use of this website or with the delay or inability to access, display or use this website (including, but not limited to, your reliance upon reviews and opinions appearing on this website; any computer viruses, information, software, linked sites, products, and services obtained through this website; or otherwise arising out of the access to, display of, or use of this website) whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if Ski Service has been advised of the possibility of such damages.
